USA: new decision in case related to Roundup

In John Carson v. Monsanto, arguments presented by Bayer were rejected

Appeals court in Alabama, United States, rejected today (12/7) Bayer's arguments in John Carson v. Monsanto Company.

Company lawyers expected a favorable decision to try to convince the Supreme Court to analyze the issue.

By after the result, Bayer stated:

"We respectfully disagree with the Eleventh Circuit's ruling because a cancer warning would deviate from EPA-approved labeling for Roundup, make the product misbranded, and require the company to make a label change that would be contrary to EPA's findings based on scientific assessments for more than four decades.

The Court's determination that the FIFRA statutory registration process is not sufficiently formal to trigger preemption is inconsistent with Supreme Court precedent, and the company will review its legal options regarding other procedures.

Bayer continues to fully support its Roundup product as the weight of scientific evidence and conclusions from expert regulators around the world continue to support the safety of glyphosate-based herbicides and that they are not carcinogenic."
