Provisional measure influences carbon credits market

The right to sell these credits may be included in the object of the forestry concession

Provisional measure 1.151/2022 was published in today's Official Gazette of the Union. The rule could stimulate the carbon credits market. Based on this rule, the right to sell carbon credits and environmental services may be included in the object of the forestry concession.

The exploitation of non-timber forest products and services may also be included in the concession object, as long as they are carried out in the respective forest management units, in accordance with the regulations of the respective sphere of Government.

Non-timber forest services can be understood as: (a) environmental services; (b) access to genetic heritage or associated traditional knowledge for conservation, research, development and bioprospecting purposes; (c) forest restoration and reforestation of degraded areas; (d) management activities aimed at conserving native vegetation or avoiding deforestation; (e) tourism and visitation in the granted area; (f) products obtained from the local biodiversity of the granted area.
