Bill provides for the control of agrochemicals in the state

The Legislative Assembly approved, this Tuesday (29/6), by 37 votes in favor and 15 against, Bill 260/2020, which changes the wording of Law 7.747, of 1982, which provides for the control of agrochemicals and other biocides at the state level.

With approval of the text, proposed by the Executive Branch, the State no longer requires that imported agrochemical products have their use authorized in the country of origin. The obligation to register the product with competent federal bodies is maintained, as well as registration with the competent state bodies.

Last year, when the PL was sent for consideration in the Assembly, Rio Grande do Sul was the only State that established this requirement for the distribution and commercialization of agrochemicals at the state level, since other units of the federation had the requirement suspended by the Supreme Court. Federal Court (STF).

“The approval of this project by the deputies brings Rio Grande do Sul back to the same level as the other states. At the same time, it establishes shared responsibility between the Secretariats of Environment, Health and Agriculture in the registration and inspection of agrochemicals”, says the deputy secretary of the Secretariat of Agriculture, Livestock and Rural Development (Seapdr), Luiz Fernando Rodriguez Junior.

Rodriguez Junior recalls that, with almost 40 years of validity, part of Law 7.747 conflicted with the Pesticides Regulatory Framework, Federal Law 7.082/1989, which determined that guidelines and requirements for the registration of products in national territory are the responsibility of the government federal, through three entities: the Ministry of Agriculture observes agronomic relevance; Ibama determines environmental suitability; and Anvisa assesses the impacts on health. Once approved by these three federal bodies, the agrochemical product is ready to be used in Brazil.
