Project criminalizes counterfeiting of pesticides and agricultural inputs

The text under analysis in the Chamber of Deputies inserts provisions into the Penal Code and the Heinous Crimes Law

Bill 2619/21, by the deputy Felipe Rigoni (PSB-ES), typifies the crime of forgery, corruption, adulteration or alteration of pesticides and agricultural inputs. The text under analysis in the Chamber of Deputies inserts provisions into the Penal Code and the Heinous Crimes Law.

“With the current legislative void, counterfeit and adulterated pesticides and agricultural inputs reach the food composition of the population. Every week, crimes related to the falsification of agricultural pesticides are reported,” said Rigoni.

According to the bill, the crime of falsifying, corrupting, adulterating or altering pesticides and agricultural inputs will be punishable by seclusion, 10 to 15 years and a fine. In the guilty mode, the penalty will be detention from 1 to 3 years and fine.

The same penalties will be incurred by anyone who imports, sells, displays for sale, has in storage for sale or, in any way, distributes or delivers for consumption counterfeit, corrupted, adulterated or altered items.

Those who carry out actions without registration, when required, with the competent control bodies will be subject to those penalties; in disagreement with the formula contained in the prescribed registration; without the identity and quality characteristics permitted for commercialization; of unknown origin; or acquired from an establishment without a license from the competent control bodies.

The proposal is being processed in conjunction with the 6299 / 02 Bill, from the Senate, ready for the Plenary agenda.
