Normative act guarantees equality in the reassessment of pesticides

Ministry of Agriculture complied with court ruling in lawsuit filed by Sindiveg

In compliance with the court decision handed down in case No. 1063042 20.2023.4.01.3400/DF, brought by Sindiveg in search of regulatory equality, the Ministry of Agriculture and Livestock (Mapa) published Act No. 55, of November 22, 2024, in the Official Gazette of the Union

The publication of this act ensures that the guidelines previously established in MAPA Act No. 71/2002 are applied to all registered products and registration requests based on the active ingredient imidacloprid. The measure ensures equal treatment for all companies and expands the range of options for rural producers, stimulating competition.

Until then, companies had been harmed by a different regulatory interpretation by Ibama.

MAPA, acting as coordinator of the reanalysis and registration process, reinforces its commitment to complying with the court decision that guarantees security, predictability to the agricultural sector and, mainly, regulatory equality.

Despite MAPA's compliance with the decision, we are still waiting for Ibama to also comply with the ruling, as part of the joint effort to ensure full respect for Justice and uniformity in administrative procedures.

Sindiveg, a trade union that has legally represented the plant protection products industry in Brazil for over 80 years, is reinforcing its work in the search for legal security and equal treatment for all companies in the regulatory process.
