Incra extends debt due date and suspends administrative deadlines

Measure protects rural producers during the Emergency period caused by the COVID-19 pandemic

Ministry of Agriculture, Livestock and Supply and the National Institute of Colonization and Agrarian Reform (Incra) published, on March 26, Ordinance No. 586 which defines the extension of the due date for debts arising from the granting of installation credit, securities domain name and administrative installments, during the emergency period resulting from the COVID-19 pandemic. The ordinance also establishes the suspension of administrative deadlines (within the scope of Incra), during the State of Emergency.

With the measure, during the period of validity of the State of Emergency, the due date of all debts arising from the granting of installation credit, domain titles and administrative installments will be extended from February 04, 2020. These deadlines will be automatically extended for 60 (sixty) days, counting from the declaration of the end of the State of Emergency.

The ordinance also provides that debts due in the period prior to February 04, 2020 are exempt from late payment charges (fines and interest) applicable during the period of calamity with COVID-19. Overdue debts resulting from administrative installments of contracts, agreements and fines, the due dates of which occur during the State of Emergency, are automatically extended for a period of 60 (sixty) days, counted after the declaration of the end of the Emergency period.

Also according to the measure announced by Incra, the deadlines for presenting a defense, administrative appeal and similar manifestations are suspended in favor of interested parties due to notifications issued by INCRA. After the end of the Emergency period, the administrative deadlines will automatically run again, for the remaining period, starting from the first business day. The Use Concession Contracts - CCU that expired during the maintenance of the Pandemic emergency period are also automatically extended for 180 (one hundred and eighty) days.
