Federal Government publishes decree to modernize agricultural defense

In self-control, private agents must implement, execute, monitor, verify and correct procedures and processes

Today's Official Gazette of the Union contains Decree 12.126/2024. It regulates the self-control programs of private agents regulated by agricultural defense. It also regulates the Agricultural Defense Compliance Incentive Program. The focus is on the sectors of products of animal origin, edible and non-edible, and products intended for animal feed.

The decree defines new risk-based inspection and inspection procedures. This allows the state to allocate resources to situations of greater risk to the community. Avoids waste in cases of low risk or negligible risk.

Minister Carlos Fávaro highlighted the importance of the new regulation. "It reflects the Government's concern with preserving the objectives of agricultural defense. It respects the autonomy of the private sector. It marks a change in the regulatory model, applying a 'responsive regulatory model'." He emphasized dialogue between regulators and those regulated and transparency in processes.

The new regulations aim to modernize. They remove interventionism from public authorities. They establish the principle of self-control. Allowing a more "intelligent" profile in inspection and inspection procedures.

The Secretary of Agricultural Defense, Carlos Goulart, explained the impact of the Self-Control Decree. "The State can direct resources to situations of greater risk to the community. At the same time, it confers more responsibility on the private agent. Without prejudice to regulatory and inspection actions, which are non-delegable powers of the State.”

Self-control programs

Self-control programs guarantee the safety, identity, quality and safety of agricultural products. They will be implemented, monitored, verified and maintained by regulated private agents. Mapa's Agricultural Defense Secretariat (SDA) will establish complementary standards. It will define specific requirements for each production sector and official verification procedures.

Under the terms of the decree:

Art. 3 Self-control programs aim to guarantee the safety, identity, quality and safety of agricultural products.

Single paragraph. Self-control programs will be implemented, monitored, verified and maintained by private agents regulated by this Decree. [...]

Art. 5 The Ministry of Agriculture and Livestock will establish in complementary rules:

I - the specific requirements necessary for the development of self-control programs for each production sector; It is

II - the procedures and frequency for official verification, considering risk assessments.

Encouraging Compliance

The Agricultural Defense Compliance Incentive Program was established in 2020. It encourages the improvement of robust and auditable quality assurance systems. It aims to consolidate an environment of trust between the Executive Branch and regulated agents.

The program requires establishments to share operational and quality data in real time with agricultural inspection. In return, they receive benefits and incentives. Membership is voluntary and can be requested via an electronic system. It is intended for establishments selling products of animal origin, edible and non-edible, and products intended for animal feed, registered with the Ministry of Agriculture and Livestock (Mapa).
