Experts will evaluate the panorama of property rights in agriculture and its effects on contracts and investments

Property rights are fundamental to agribusiness, as rural producers invest heavily in their farms to ensure sustainable, efficient and quality production, assuming commitments with suppliers, buyers, consumers and, depending on the size, with their employees and their respective families. This means that legal property uncertainty can affect the business environment, with direct impacts on agrarian contracts. To address this topic, the Brazilian Congress on Agribusiness Law, scheduled for March 19, 2024, in São Paulo, will have the participation of experts in the areas of law and investments. Registration to participate in the event, with free virtual broadcast, is open on the official website.

“We are living at a crucial moment regarding property rights, with the promulgation by the Chamber of the complement to the Temporal Framework Law and the decision of the Federal Supreme Court (STF) on the unconstitutionality of the topic. Therefore, debating the topic is important, in order to guarantee security for the agricultural business environment”, says João Lima Junior, Partner at Lima Junior Domene e Advogados Associados, who will participate in the panel Property Law, Social Function and Contracts Agrários, alongside Guilherme Rodrigues da Cunha, CEO of Ceres Investimentos; Rudy Ferraz, Legal Director of the Brazilian Agriculture and Livestock Confederation (CNA); and Thiago Castelliano, Judge at the Court of Justice of the State of Goiás. Francisco de Godoy Bueno, Advisor to the Brazilian Rural Society (SRB), will be moderated.

The panel will also provide a history of legal decisions on the time frame and the reasons that justify the last STF decision, in 2023, on the topic; will delve deeper into issues linked to institutional dialogue, land conflict and repossession; and will assess the impact of property rights on agrarian contracts.

The Congress, designed by the Brazilian Institute of Agribusiness Law – IBDA, will also feature three more panels, which will cover fundamental themes for legal security, economic growth and competitiveness of the sector: Agribusiness and Capital Markets – FIAGRO Regulation ; Risk Management, Credit and Judicial Recovery; and Green Transition: Bioeconomy and Legal Instruments.

The program will be opened by former Minister of Finance Maílson da Nóbrega, economist and partner at Tendências Consultoria, who will give the inaugural lecture Taxation and Economic Order. Throughout the event, IBDA will pay tribute to one of the most important jurists in Brazil, the lawyer, professor and writer Arnoldo Wald, partner and founder of Wald, Antunes, Vita e Blattner Advogados.
