ANTT approves review of calculation of minimum freight rates

The National Land Transportation Agency (ANTT) published in the Official Gazette of the Union on December 30, 2024, the revision of the Resolution that amends the general provisions and Annex II of Resolution No. 5.867, of January 14, 2020. The Resolution establishes the general rules, methodology and calculation coefficients of the minimum floors referring to the kilometer traveled in the performance of the paid road freight transportation service, per loaded axle, established by the National Policy of Minimum Floors for Road Freight Transportation. 

During the 87th Extraordinary Board Meeting, broadcast live on ANTT's official YouTube channel, the Board of Directors decided to review the Resolution on two main points:

• Inclusion of section 5 of article 9, establishing as an administrative infraction the failure to declare the value of freight paid in the tax transport documents, declaration of a value equal to zero or below the established minimum floor, with a fine of R$550,00 (five hundred and fifty reais);
• Update of minimum freight floor coefficients.

The update of the minimum floor coefficients considered the results of market research carried out to update the values ​​of the inputs that make up the operational costs of transportation, as it was observed that the successive updates of the inputs only by applying the IPCA (Broad National Consumer Price Index) can cause a detachment of the reference values ​​adopted in the calculation spreadsheets in relation to those actually practiced in the market.

At the meeting, the directors also approved the report of Public Hearing No. 8/2024, held from October 23 to November 22, 2024 with the aim of gathering input for improving the proposal. 

History

The review process of the aforementioned Resolution began with Subsidy Collection No. 03/2024, which ended on June 28, 2024, the objective of which was to receive initial contributions to improve the standard.

Market research was then conducted to update the values ​​of the inputs that make up the operational costs of transportation. The results of the studies and research supported the preparation of a proposal to revise the resolution in question, which was submitted to Public Hearing No. 08/2024.

After analyzing the contributions received at the Public Hearing, the two main changes were proposed, which were then put to a vote at the 87th Extraordinary Board Meeting.
