An inspection operation carried out by employees of the Mato Grosso Agricultural Defense Institute (Indea), with the support of the Military Police (PM/MT), resulted in the seizure of 15.710 kilos of irregular sesame seeds. The action occurred during a moving barrier on the MT-326 highway, in the section that connects Cocalinho (MT) to Aruanã (GO), where a truck was intercepted and inspected.
The destruction of the seeds occurred in the municipality of Água Boa and was the result of the process provided for in State Decree 1.652/2013, called "seed condemnation", which includes trials in the 1st and 2nd instances in which the inspected person can appeal and present the documentation legally required by state law.
During the inspection, the agents found that the seeds, coated with graphite, were packaged in bags designed for seeds, but the truck driver did not present documentation of the origin of the material. Decree 1.652/2013, which regulates State Law No. 9.415/2010, requires the presentation of an invoice, certificate of genetic origin, certificate or term of conformity, permission to transit vegetables and an addendum to the seed certificate.
The absence of mandatory transit documents, as well as the failure to provide the Producer or Trader's Renasem registration number constituted a violation of Law No. 9.415/2010 and Decree No. 1.652/2013. In view of the irregularity, the 15.710 kilos of seeds were seized, due process was initiated and forwarded to the Seed and Seedling Trade Inspection Program of the Indea Plant Health Defense Coordination. After analysis by the judging committee in the first and second instances, it was decided to condemn the seeds with the summary destruction of the propagating material.
The inspected person was instructed regarding the requirements set out in state legislation for the transport of seeds and requirements for the material to meet the identity and quality standards established in specific state or federal standards.
In view of the infraction found, as a punitive measure provided for in Decree 1.652/2013, an infraction notice was issued in the amount of 91 Standard Fiscal Units of Mato Grosso (UPF-MT), totaling R$ 27.728,98, to the owner of the seeds.
