Brazilian Agribusiness Law Congress will be on March 19th

The event will raise debates about the importance of legal instruments for the green transition in Brazil

Legal instruments are essential for the Brazilian green transition, as they determine the rules and obligations of each party, whether public, private or interinstitutional, imposing transparency, protocol, procedures and deadlines. The country has the opportunity to be a protagonist in this process, especially because it has an agribusiness that combines productivity, competitiveness with sustainable techniques, low-carbon agriculture and bioenergy. The topic will be debated by experts during the Brazilian Congress on Agribusiness Law, scheduled for March 19, 2024, in São Paulo, with free virtual broadcast. “The green transition, in the context of the bioeconomy, will point out the paths, how the objectives can be achieved and what legal instruments are necessary for this to happen gradually. The transition needs to start with a change in mindset, then moving on to planning and then action. Therefore, it is necessary that legal instruments appropriate to legislation, procedures, protocols are constructed throughout this process, which cannot take long”, assesses Samanta Pineda, Lawyer specializing in Environmental Law, moderator of the panel Green Transition: Bioeconomy and Legal Instruments .

The panel will have as debaters: Ana Luci Grizzi, Partner at EY Brasil and Latam Vice-Leader of Sustainability and Climate Change; Christopher Garman, Executive Director of the Americas of Eurasia Group; Marcos Jank, Coordinator of the Insper Agro Global Center; and Daniel Vargas, Coordinator of the Bioeconomy Observatory at Fundação Getulio Vargas (FGV).

“Without adequate legal instruments, it is very common to encounter obstacles and bottlenecks, which cause that purpose to end up being lost, due to a lack of means, procedures, rules, deadlines. In this way, the legal instruments will provide the functionality for the transition to actually happen, guaranteeing the safety of everyone involved”, adds Samanta.

Throughout the panel, congressmen will be able to follow the different assessments brought by the four experts, which will contribute to overcoming challenges, such as the speed of this transition, and how to carry out this process safely. In this context, topics related to the geopolitical context, the legislation of other nations and economic blocs, the influence of the sustainability agenda on the world's major challenges and global governance, the traceability of the production chain and the energy transition will be addressed. Issues linked to the legal revolution underway with the green transition, environmental assets, carbon, financing mechanisms for new assets and auditing of environmental projects will also be addressed.

The Brazilian Congress of Agribusiness Law, created by the Brazilian Institute of Agribusiness Law – IBDA, will also feature three more panels, which will cover fundamental themes for legal security, economic growth and competitiveness of the sector: Agribusiness and Capital Markets – A FIAGRO regulation; Property Law, Social Function and Agrarian Contracts; and Risk Management, Credit and Judicial Recovery.

The program will be opened by former Minister of Finance Maílson da Nóbrega, economist and partner at Tendências Consultoria, who will give the inaugural lecture Taxation and Economic Order. Throughout the event, IBDA will pay tribute to one of the most important jurists in Brazil, the lawyer, professor and writer Arnoldo Wald, partner and founder of Wald, Antunes, Vita e Blattner Advogados.
